Waiver and Release of Liability and Assumption of Risk:

By clicking Submit and by completing the on-line service request process, you agree on behalf of yourself, your company or employer that you represent, your successors, heirs, assigns, executors and administers as follows:

I wish to get my bicycle, tricycle, e-Bike, stationary trainer, piece of exercise equipment, motorized vehicle, motorcycle, or other ICE gas powered vehicle, herein referred to as "equipment", serviced, repaired, built, or upgraded, herein referred to as "service". "Pedal & Chain Mobile" refers in this agreement to any and all affiliated entities or entities that control or are related to Pedal & Chain Mobile and any related or associated sponsors or entities including, but not limited to, the owner(s) of Pedal & Chain Mobile, the property owners, and tenants where the service is rendered.

Waiver/Release: I understand that cycling is an activity that may involve risk of injury or death, risk of permanent or partial disability, and
further, may result in economic losses including medical or hospital bills, and damages to real and/or personal property. I further understand that once the service is complete and the equipment returned to you, hazards of riding the equipment are to be expected and cannot be eliminated or controlled. I agree that in consideration of receiving service on the equipment, I release, waive, discharge and covenant not to sue Pedal & Chain Mobile or its owner(s) for any and all losses or damages, any and all claims or demands, and any other injury or loss to me or my property or resulting in my death, whether caused by the active or passive negligence of Pedal & Chain Mobile, arising from or related to my receiving service by Pedal & Chain Mobile and its owner(s), employees, or representatives.
Acknowledgement and Assumption of Risk: I hereby certify that I understand, accept and fully assume any and all risks associated with my receipt of service on my equipment. I acknowledge that I am solely responsible for my personal health and safety, and the personal
property I am getting serviced. I also acknowledge and accept full and sole responsibility for any medical expenses arising from my use of the serviced equipment.
Release, Hold Harmless, and Indemnification: I agree to release and hold harmless Pedal & Chain Mobile from and against any and all liability, for any and all losses, damages, claims, or demands, on account of injury to me or my property, that may arise from servicing of the equipment, whether caused by the active or passive negligence of Pedal & Chain Mobile or it owner(s) or representatives. I further agree to indemnify and hold Pedal & Chain Mobile harmless from and against any and all damages, costs, claims or demands, including reasonable attorneys fees, made by any third party due to or arising from or relating to servicing of my equipment.
Waiver of Any Intellectual Property Rights: I understand that Pedal & Chain Mobile and their licensees, affiliates and employees may use my name, photograph, voice or likeness for any legal purpose. I consent to and authorize, in advance, such use and waive any rights of privacy and/or publicity I may have in connection therewith.
Limitation of Liability: PEDAL & CHAIN MOBILE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL
OR CONSEQUENTIAL DAMAGES, RESULTING FROM SERVICE RENDERED ON MY EQUIPMENT.
Severability: I understand that, in the event that any one or more of the provisions contained in this Waiver and Release shall, for any reason, be held to be invalid, void, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect any other provision of this agreement, and the remaining portions shall remain in full force.
Choice of Law: I agree that the validity of this Agreement and of any of its terms or provisions, as well as the rights and duties under this agreement, shall be construed pursuant to and in accordance with the laws of the State of California.
Entire Agreement: This Agreement is the sole agreement between the parties. No other agreement, whether implied, oral or written, shall be binding upon either party to this agreement, unless this agreement is amended in writing and signed by an officer of Pedal & Chain Mobile.

I HAVE CAREFULLY READ THIS WAIVER AND RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I am aware that this is a RELEASE OF LIABILITY and a contract between Pedal & Chain Mobile and me, and shall serve as a release of all liability relating to Pedal & Chain Mobile, the respective officers, directors, agents, employees, representatives, and associated parties and entities, including but not limited to, the owner(s) of Pedal & Chain Mobile, the property owners, and/or tenants where the service is rendered.
